All EB-5 investors must invest in a new commercial enterprise that (1) was either established after November 29, 1990, or if established on or before that date, is purchased and restructured or reorganized so that a new commercial enterprise results; or (2) is expanded through investment so that a 40-percent increase in the net worth or number of employees occurs.  There are additional qualifications, requirements and subtleties, so you should contact your Agins Law Firm Chandler/Sun Lakes EB-5 Investor Visa attorneys for further clarification regarding this investment opportunity.

A qualifying capital investment under the EB-5 Investor Program must be either:

 - an amount of $1,000,000; or

-an amount of $500,000 in a Targeted Investment Area, which is defined, generally, as (1) an area experiencing unemployment of at least 150 percent of the national average rate; or (2) a rural area situated outside a metropolitan statistical area or outside the boundary of any city or town having a population of 20,000 or more, according to the
most recent ten-year census.

Qualifying Job Creation requires either (1)that 10 full time direct new jobs be created within two years of the investor's admission to the U.S. as a Conditional Permanent Resident; or (2)that 10 full time direct jobs be preserved within a troubled business in which the investor's money was invested (or indirect jobs, if within a business affiliated with a Regional Center project).  Again, there are strict limitations surrounding these requirements and navigating the regulations successfully is critical to obtaining Legal Permanent Resident status, so contacting your Agins Law Firm EB-5 Investor attorneys is a good way to ensure that you attain your immigration and EB-5 investment project goals.

Because of our unique combination of training and experience in accounting, finance and business, we are positioned to prepare business plans targeted to EB-5 visa investment projecs.  Please contact us to discuss this capability.

The United States Citizenship and Immigration Services ("USCIS")  administers the Immigrant Investor Program, also known as “EB-5.” The program was created by Congress in
1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors. Under a pilot immigration program first enacted in 1992 and regularly reauthorized since, certain EB-5 visas also are set aside for investors in Regional Centers designated by USCIS based on proposals for promoting economic growth.
